An alternative is to contact Cobra and find out from them if you MUST rejet with their pipes and stock air kit, and bring that info to the dealer.
Let Cobra give you the info to bring to the dealer if it confirms what has been said in this thread by members. that is a great idea; i will be doing that the first of the week for sure. thanks!

Here's the link to the poormans BAK. If you do it will have to start from scratch on your jetting. Poormans

You have got help. If you are going to keep the stock air box get a stock needle and jets. You can put a K&N in the stock box but that still doesn't require jetting.but will the K&N filter in my STOCK box really improve the air flow into/through the air box with the stock configuration!?!

Nope. Not much. That's why you don't have to jet. It's not really the filter that is restrictive. It's the air box.

You need to go to some bike parts websites and do some research. See what's available and what things look like. That will help you a lot. The BAK is an air kit. It replaces everything. That's a BAK on mine.

B4, you can put on a BAK or similar after-market air box, but spending that money may not resolve your issue. You may still have to rejet depending on what the dealer put in during his rejetting.
It still could burn rich, so look into things before you drop a couple of *C* notes.
EDIT: You never mentioned your jetting in this thread, although members discussed how it should be in detail. Did you ask the dealer what jetting he installed? Can you find out before you go buying add-ons?
