It's hard to believe, but all one need do is look at this link to the bs that has gone on.

Unbelievably, since the last round of crap I have not heard anything until yesterday morning, when the states attorneys office called me and told me I had to come to court for jury selection 9:00 Monday morning (10/06/2014 AT 0900AM IN COURTROOM 4B/ JUDGE JAMES J. DEKLEVA), for a charge of reckless driving. Again words came out of my mouth telling how this has been the biggest carnival ever. They always say they understand. They do not. So, later in the afternoon, about 5:30 they call back, telling me if I don't show up to jury selection there will be zero case. The prosecutor also said with all of the evidence thrown out by Judge Kenneth Lester, it's going to be hard to get any conviction for anything.

the way I read it (and that's hard to read) the defense made a motion for automatic discharge and the court denied it....maybe with this new judge some of the things that was thrown out can be resubmitted....

Any word on why a new judge? I hope they finally get this done and get this guy off the roads

As I've been cynically saying all along, that's how it works. They defense keeps bouncing things around, asking for continuances, etc., until the other side doesn't make it. I'm surprised you got this much notice, and they didn't wait until 8:30 AM Monday to inform you of the date.

It would really be interesting to watch that one that was just posted with bicycle. A bunch of witness, but they will all take days off of work to testify at court dates that are rescheduled, until they get short notice on the next court date and miss it. Every time enough of the witnesses show up in court the defense will find an excuse for a continuance, until all of the witnesses get sick of wasting their time to try to do the right thing in the court system.

(Can you guess why I don't get picked for jury duty after the interview..? )

What did your lawyer do about all of this? From day 1, you had a civil suit. I mentioned this to you a year ago. Told you to get an attorney. Did you? No you waited for the system. Without an attorney for the system to answer to, they drilled you. Sorry to say but they got you. You got what you put in, you got little out. DA elected official, judge elected official, without your own attorney what did you expect? Sad to see the outcome,

A civil case has nothing to do with a criminal case. The prosecutor prosecutes the case, not your own attorney. I spoke to lawyers so don't tell me different than they explained.




In any case, today is the day I am expected to show up for the remnants of the circus. Very strangely this morning I noticed two black men standing out front. I have cameras aroound the perimeter of my house, a 2TB server. So as I'm talking to the woman on her way to work I tell her this. I hit the key to unlock my truck so the lights flash and they suddenly leave. I go down to the truck and proceed out the sub the only way in, drove the entire sub, no sign of these two anywhere.

I know who walks by, runs, walks their dogs and what time my neighbors do this shit. I get back home and on the phone with the woman and go to review the cameras, nothing on anything, NO FILES FOUND wtf



I can't even say what I want, and truthfully I don't even want to go to court because I fear I am going to say things and get in trouble. Now I am compelled to go. IIRC the last time there was a court date people were out front, I called the city police dept and had them come out. I don't even know what to think at this point.

You need to go. If you feel intimidated, I'd understand, but you still need to go. If I was closer, I'd try to help and come over and "watch the watchers" for you. I've done that in the past for someone dealing with a radical ex. The appearance is much more important than the reality sometimes. I'm pulling for ya bud.
If I seen them again I'd straight up snap a pic of them and send it to the DA. Might be worthless, but sends a message the other way. They may be trying to intimidate, or perhaps provoke.

Agree with JD. Take as much to 'em as you can. You never know what might play out with a new judge.

So things that you are seeing are not on the video files? Interesting.
Probably a poor example of extremes, When Oj offed Nicole the family filed a civil suit. Result was not the financial gain. Fact was an attorney ( their) was following everything the DA/ Judge did. Thus the court held in check. You had nobody with legal skills
on your team. You did not get an attorney and sat and waited for the mail. Welcome to the judicial system. Glad it's a year latter and you are alive to enjoy.

Brother you definitely need to get a lawyer and file a civil suit. In a criminal trial the prosecution has to prove "beyond a reasonable doubt" in a civil trial you only have to prove "a preponderance of the evidence" HUGE difference! In a civil trial, all the evidence that was suppressed in the criminal trial can be used. Totally different rules. If nothing else you could receive a really good judgment. You may or may not see any actual money, BUT you could get the civil judge to slap an injunction or that S.O.B and if he ever does get anything such as money or property he will have to give it to you!. At least you could hang an albatross around his neck that will follow him for the rest of his life. HE will always know you didn't take his crap!
