phx pd shows up even if there is not injury and they give tickets but do not arrest as for the bike if damage is 75% or greater then blue book it will be totaled you will get fair market valve some insurance companies will lessen the valve of a bike if it has after marcket parts unless you have custom motorcycle insurance i went though this back in jan when the chevy pick ran me over i got 5930 cash for the bike (wgich i paid 3800) kept the bike(490 to fix) and 3500 cash for the broken rib it took 3.5 months to setal everthing i did have the estimts for everything ready for the adjuster by the time he came to see the bike so i did part of his job for him and the driver did get tickets

TAKE PICTURES NOW, video record everything you can including peoples statements, by the time this gets to court (and it will) you will be healed have no road rash to show and peoples memories will get adjusted by the opposing lawyer. Been there, done that!!! Don't even try to work, sue for lost wages ( you might be able to get that from your insurance, depends on the policy) if you work then that shows that you really aren't that bad. Good luck.

I agree with zoom and if you have receipts for your after market parts show them to your insurance. They totaled my 05 and I produced my receipts for all my stuff and beside that the dealer told the adjuster that they couldn't put a value on the bike that it was custom and was totaled. The insurance gave me $8600 for the bike and I bought it back and they handed me a check for $6800 and $250 for my towing. I bought the 07 for $7000 before the gave me the check so you can come out ahead not I have two bikes.

Absolutely correct. Got hit July 2004, got a settlement check July 2006. That's right, 2 years and a couple weeks. Nationwide insurance made a settlement offer my lawyer was ok with 2 days before my case went to trial in civil court. They played the waiting game and so did I. Funny thing is they ended up paying 4 times more than I offered to settle for before the lawyers got involved.

The adjuster actually told me that they wouldn't pay medical costs since my health insurance was covering the bills. That's when I called a lawyer and told Nationwide to F-off.

Get a good lawyer and be patient it could be a long ride. Financially it worked out very well for me but I never want to go through it again.

BTW, your health insurance will most likely put a lien on your claim to get their money back. I had both UHC and MedMutual and they were very easy to work with. I only paid co-pays for visits and surgeries and they covered the rest until the case was settled.

Man, that sounds aweful...sorry to hear about this but you'll continue to improve as it sounds like you are in good hands. Don't give up on yourself. You'll reach plateaus in your progress but keep breaking through.

hang in there it WILL work out. Insurance companies are terrible about paying out but they always end up paying

Heal well and fast, JA. Now that he lawyers are involved, let'em earn their fees (normally in the 1/3 range). Take the ins. co. for everything you can ... they wouldn't hesitate to fleece you. Or to hose ya for that matter.
