He can sit in jail just like the rest of the drunk (drinking) drivers. And twice as long since he caused an accident. Make it three times as long since it was a cycle rider.
I guess his excuse will be, "I didn't see him! I was blind drunk!"

EDIT: Quote from a news article...

"This is the second time in two years he has been involved in an accident.

The North Carolina Highway Patrol charged him with reckless driving and leaving the scene of an accident in 2007, but those charges were later dismissed."

He may walk since it was in NC and he is a Nascar driver. He may not be able to duck so easily his sponsor getting upset with him. Time to retire Mike. Actually it was a number of years ago.

What a tool, .06 still means he was driving with alcohol in his system. Friggin guy makes a living turning left and cannot even do it right in a u-turn.

Here in AZ you can be considered impaired with ANY measureable aclohol in your system....pretty low tolerance out here, which is OK with me!

.06 may not be "driving while intoxicated" DWI, But they should still charge him with "driving under influence" DUI.
