Nope, 80% drunk is not drunk at all. Not unless you've found a state with a 0.0% law. It's the same as driving with Big Mac or an iPOD in your hand and just as likely to cause harm.

You guys can bash him (or me) all you want, but my only "legal" responsibility is to operate my motor vehicle to same level as an 80+ year old little old lady in an Oldsmobile.

I've been hit twice, neither time by drunks. Let me tell you, it didn't hurt one bit less.

We all agree to some level of risk everytime we throw our leg over the saddle. If I was all that worried about #3, well, I guess that's why they invented Hummers.

Well, I'll say this so we all know where I stand . .06 is .06. Legal limit is .08. He was legal. Deal with it. I go out with my wife to dinner quite frequently and have a beer sometimes two with my dinner. Oops gues that makes me a drunk driver. Responsible behavior is exactly what it means, being responsible. Not paying attention while driving anything, and I do mean anything, is what causes exactley what we have here. The man has a few drinks and you want to friggin crucify for being a law abiding citizen who wasn't drunk, Albeit a bonehead driving manuveur. If you don't like the laws then go vote the idiots who make them out of office. Untill you do that the legal limit is exactley what it is in certain states like Texas where its either DWI or be careful and thanks officer. I aint trying to sound like a jerk but hell if you don't like the way the law is there don't live there. I aint dissagreeing one bit that he made made a bad decision in making a U turn and hitting someone. If it had been a stock car maybe he would have a tree instead, who knows. If anyone that just read this got offended, congrats. Be proud your an American and you have the right to your own opinions.

This article states that he passed on the spot field tests given to determine if a blood test or breath test are needed which he took and blew a .06 and that is below the legal limit of .08 for that state.It also states that driver #2 the bike rider had a few beers as well.I agree that the law is the law and if you do not like it work to get it changed...lol and I am by no means a Waltrip fan nor do I drink and drive....Coug

I lost respect for him a few years back while at talledega. Can't remember which race it was, but his car ended up on the roof. The emergency workers were trying to figure out how exactly to get him out (I suppose). He made a comment during a television interview that they should have just flipped his car over and everything would have been fine. He basically bashed those emergency workers because he he thought he knew how to do it better.

Here is my problem with that. I have a career in Fire/EMS. We know how to do our job. That is what we are trained to do. Those emergency workers on the track are certified just like I am. They are not just john Q public off the street. We don't tell them how to do their job on the track, so don't bash those guys because you think you could have done it better. Next time maybe he will have fractured his neck, those emergency workers will just flip his car over breaking his neck and possibly paralyzing him for the rest of his life, or even worse. Don't tell us how to do our job and we won't tell them how to do theirs.
