Barry seems to forget, that many of the controversial things FDR tried to do, got tossed by the Supreme Court as well(even with FDR's attempts to pack the court...maybe that'll be Barry's next move...13? 15? 17 justices??).
This legislation passed the House with only democrat votes except for Cao(who got chopped off at the knees..imagine his surprise), an astounding contrast to legislation of this magnitude in the past, where some bipartisanship(one vote, isn't bipartisanship) was considered necessary.

That a sitting president, would attempt to bully the Supreme Court into capitulating to his views is simply "beyond the pale". Drudge put up a link yesterday regarding the real possibility, that the presidents statements, were initiated by leaks, from the SC deliberations.

That people embrace this hysterical socialist and his tactics, bodes ill for the future in this country.

Yes, FDR's court-packing plan, just as with Obama's budgets, did not even garner Democrat support. Much of FDR's socialist agenda was rejected by the courts.

Obama is depending on an uniformed electorate -- once again -- regarding the history of SCOTUS and their role in legislation.

If I may... originally, the House was the voice of the people, and had the most power. The Senate was to help balance the power between the larger and smaller states.

The Chief Executive, i.e., the President, was to execute the will of the people, as expressed by the legislative branch.

The Supreme Court was to serve in an advisory capacity to both the Congress and the President, as to the Constitutionality of the bills entered or passed by the Congress.

Note, I said an advisory capacity. If the Congress and the President chose to overlook (ignore) the OPINION of the Court, they could do so.

The Court NEVER had the final say on anything... they originally met in the BASEMENT of one of the other governmental buildings, as they had no digs of their own!

It was the power of the people, expressed through Congress, executed by the President, and an advisory Court as to the Constitutionality of the laws being considered, passed and emplaced.

Here, in MA, the home of such ideas, our state constitution begins with the peoples' rights, as given by God, the power of the General Assembly, then the authority of the Executive, i.e., the Governor, and finally, a few paragraphs detailing the advisory role of the state supreme judicial court, which was to be taken into account, whenever requested, to pass a constitutional opinion on a legislative matter... which the legislature (power of the people) could take under advisement, or overlook!!!

My, how far we have strayed!!!

Oh, by the way, a simple read of our state's constitution, written by John Adams, makes all of this perfectly clear... but, who even knows, or cares, anymore!

The idea that the separate branches were to be equal was a later one. The Legislative Branch was to be first, the Executive Branch second (to do the will of the Legislative, i.e., the people) and the Judicial Branch last, to serve in an advisory role to the other two. And it could be over-rode, overlooked, ignored, if the other two branches chose to do so.

It is so totally different today. And, so totally sad, too.
